Following previous extensions of temporary reliefs - see HazMat Alerts 2020-41 and 2020-42 - on July 10, the Pipeline and Hazardous Materials Safety Administration (PHMSA) issued a Notice of Extension of Enforcement Discretion for the Transport of Certain Sanitizing and Disinfecting Products. This extends the relief originally reported on in 2020-23 on April 20, 2020.

PHMSA’s enforcement discretion applies to the transport of cleansing necessities, including hand sanitizers or disinfectant spray, to locations, such as sorting facilities and loading and unloading facilities, where they will be used by employees that directly support the transportation operations of the carrier.  Additionally, enforcement discretion is limited to transportation by highway motor vehicle.
