Today, on July 8, the US Department of Homeland Security (DHS) published in the Federal Register a document titled Chemical Facility Anti-Terrorism Standards; Personnel Surety Program Implementation Notice. DHS is providing notice to the public and chemical facilities regulated under the Chemical Facility Anti-Terrorism Standards (CFATS) that it is commencing full implementation of the CFATS Personnel Surety Program at all high-risk chemical facilities.

CFATS requires regulated chemical facilities to implement security measures designed to ensure that certain individuals with or seeking access to the restricted areas or critical assets at those chemical facilities are screened for terrorist ties. The CFATS Personnel Surety Program enables regulated chemical facilities to meet this requirement.

On Thursday, July 2, 2020, the Pipeline and Hazardous Materials Safety Administration (PHMSA) issued a Notice of Extension of Enforcement Discretion for Cylinders Exceeding Periodic Testing Dates. PHMSA originally issued this enforcement discretion on April 7, and we reported on it in HazMat Alert 2020-22. PHMSA will continue to not take enforcement action against any person who fills a DOT-specification cylinder used to transport Division 2.2 non-flammable gas provided the cylinder meets all requirements of the Hazardous Materials Regulations (HMR) except that the cylinder is overdue for periodic requalification by no more than 12 months.
